Leasehold vs Freehold in Kedungu

Not a single villa on this coast changes hands as freehold. Freehold land exists here too, priced separately and by the are, but it belongs to a different part of the market entirely. Confusing the two is the fastest way to misread a listing.

What Each Tenure Actually Is

Hak Milik, freehold, is a registered certificate held at BPN, Indonesia's land agency, and Indonesian law keeps it out of foreign hands under the UUPA. Hak Sewa, leasehold, works differently: it lives entirely in a private, notarised contract for the use of someone else's land, with no certificate at BPN behind it at all.

That distinction decides who protects you. A freehold buyer relies on a registered title the state itself tracks. A leasehold buyer relies entirely on the wording of their own contract, drafted and witnessed by a PPAT or notary, since no government register stands behind it.

Treat that leasehold per-are figure as one listing's own pricing, not a rate you can apply to a different parcel with a different remaining term.

One Nyanyi Listing Shows the Mechanics

A raw land parcel marketed for villa construction in Nyanyi puts the abstract version of leasehold into a real number. The plot carries a lease that runs out in October 2051, and its contract adds a separate extension clause worth another 30 years on top, per Harcourts Purba Bali.

That extension clause is doing real work in the price. A buyer taking the parcel today is really pricing roughly 25 years of certain use plus a further stretch that depends entirely on the landowner honouring a clause, not a right anyone can force.

Compare that against Kedungu Real Estate's own villa terms: one bedroom sits close to three decades, two bedrooms land at 25, and three-bedroom stock spans between 23 and 29 years. None of those listings publish an extension clause at all, which is itself worth asking a seller about directly.

Matching the Tenure to the Buyer

Freehold suits almost nobody reading this page directly, since foreign buyers cannot hold Hak Milik and a PT PMA cannot either. It only becomes relevant if you are pricing land a local partner or company structure might hold on your behalf, and even then Hak Milik itself stays out of a foreign-invested company's reach.
